Liability - Gomez operates as an “independant CFI” and carries insurance to cover any incidents or accidents that may occur when Gomez is operating as Pilot In Command (PIC.) This insurance is intended to cover liability property damage and damage to the aircraft. It does not cover injury to passengers as a result of any accident or incident.

Covenant not to sue and release of personal liability - Student acknowledges that engaging in any flight activity encompasses inherent risk and may result in personal injury or death. Student agrees to accept any risk inherent, foreseeable, or non foreseeable related to any flight activity, which includes ground operations, flight training operations, and any operation that could be reasonably interpreted as such. Student acknowledges and agrees that Gomez shall not be held liable to any personal injury or death as a result of engaging in Flight Activities. Student also agrees to hold harmless, release, and exempt Gomez and any associated parties such as family and business associates from any and all claims resulting from any personal injury or death as a result of engaging in any Flight Activity. Student agrees to not bring any claim, lawsuit, demands, actions, injury, or pursue any other claim for damages against Gomez. Student also acknowledges that they are of legal age to sign such agreement, and are of full mental capacity to agree to the aforementioned terms, and are signing this agreement in their full free will, and reserve the right to cancel this agreement at any time.

Responsibility of Gomez - Gomez agrees to operate and conduct Flight Activities in full observance of any applicable Federal Aviation Regulation and with reasonable safety precautions and standards. Reasonable safety standards means safety measures that other qualified instructors or FAA personnel would agree with and find applicable. Gomez reserves the right to discontinue or cancel Flight Activities at any time when applicable regulations or safety standards cannot reasonably be met. Student agrees to pay for any instructional time or flight time leading up to such a discontinuance.

Student Insurance - In pursuance of FAA certificates, solo flight time is required. Solo flight time means flight where the student is the sole occupant of the aircraft. As such, Gomez can not be held responsible for any damages that occur when the student is flying Solo. During these flights, the Student operates as Pilot in Command (PIC.) Student agrees to carry insurance covering themselves and the Aircraft prior to being released Solo. If student does not meet this requirement, Gomez reserves the right to withhold the appropriate Solo endorsements which are required under FAA regulation to fly solo legally.
Aircraft Agreement

Gomez operates aircraft provided by Mann Aviation Inc of 2601 E. Spring Street, Long Beach, CA 90806. Gomez agrees to follow any agreement issued by Mann Aviation Inc. If student is to operate in a Mann Aviation Inc Aircraft, they agree to sign all agreements issued directly from Mann Aviation Inc and abide by any rules set by Mann Aviation in such agreement. They also agree to carry any required insurance required by Mann Aviation in order to operate in their aircraft. Student agrees to exclude Gomez from any liability in result of a dispute between Student and Mann Aviation Inc.

If Gomez agrees to engage in Flight Activities in the Student’s owned aircraft, Student agrees to ensure any pertinent insurance coverage for the desired Flight Activity. Student agrees to exclude Gomez from any claims resulting from their actions in Student’s owned aircraft. If Gomez is deemed liable for any action while flying as Pilot In Command (PIC) then Gomez agrees to initiate a claim against his Non-Owned Aircraft CFI insurance Policy up to the coverage limit.

If a student desires to engage in Flight Activities in a non-owned aircraft that is not associated with Mann Aviation Inc, Gomez must be authorized in writing by the aircraft owner to conduct Flight Training in said aircraft. Gomez reserves the right to refuse service in these planes and will use his own judgment to make a decision and accept or reject aircraft owners terms.
